TERMS & CONDITIONS

By entering the competition, you are agreeing to the following terms and conditions:

1. STANDARD TERMS

1.1 Information on how to enter ‘Koyama Kings – Road to Cairns Ukulele Festival’ forms part of the terms of entry.

2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all residents of Australia Only.

2.2 Employees and their immediate families of Dominant Music Australia, Koyama, Cairns Ukulele Festival and any of their associated agencies and companies are not eligible to enter.

3. HOW TO ENTER

3.1 The competition commences on Sunday the 1st of May 14 2014 at 10:00am AEST and concludes on June 13 2014 at Announcement of the winner.

3.2 In order to enter for the major prize, entrants must follow the instructions and fill out the required information on the Facebook application, hosted on the Koyama Australia Facebook page.

3.3 Entries for the major competition must be received by June 12 2014 at 11:59pm AEST

3.4 Conditions of entry

3.4.1 The entrant must have permission/rights to record or publish the song recorded in the video

3.5 Multiple entries per group are permitted.

4. PRIZES

4.1 There will be one major prize winning group

4.1.1 The major winner will receive a prize package as set out below

4.1.2 No cash alternatives to prizes will be offered.

4.1.3 Printing errors or other quality control matters outside the control of individual players will not be used as the sole basis for refusing to award a prize.

4.2 The prize consists of:

4.2.1 The major prize is awarded to a Ukulele club or group and consists of 3 Koyama Ukulele’s (Approx value $449.85AUD), A spot on the major showcase at the Cairns Ukulele Festival (Priceless), Free entry to the festival finale concert for all members of the group to a maximum of 10 people (Approx Value $630AUD)

4.2.2 The Ukulele’s will be shipped to the winning groups registered address, within 60 days of the announcement date. The prize can not be exchanged for other products or cash. Standard warranty terms apply to the instruments and the serial numbers will be registered agains the winning groups name.

4.2.3 The prize does not include any flights or travel allowance for the winning group to get to Cairns. The expenses of the group to arrive at, play at and return from Cairns, Australia to play at the festival is at the winning groups own expense.

4.3 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition. The winners agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

5. HOW TO WIN THE MAJOR PRIZE

5.1 Each entrant and related group members who has entered the competition over the duration of the competition and registered all details required (“Qualifying Entrant”) will be eligible.

5.1.1 Entrants will be prompted to share the contest on Facebook to gain more entries into the contest.

5.2 Each entrant’s video will be available on the application for voting, during the voting period (June 7-12 2014).

5.2.1 Entrants are encouraged to share their entry as much as possible to encourage voting.

5.2.2 At the end of the voting period on June 12 at 11:59pm AEST, the entry with the most votes will be deemed the winning entry

5.3 Winners will be notified by a phone call and/or email by Tuesday the 1st of April 2014. The winner’s name will be published on the ‘Koyama’ Facebook page and the Cairns Ukulele Festival Facebook page and website on the same day.

5.4 The promoter’s decision is final and the promoter will not enter into correspondence regarding the result.

5.5 The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

5.6 If the winner of the major prize fails to claim their prize within 7 days from the original announcement date, The entry with the 2nd most amount of votes will take place. In such circumstances this will be announced on the same public spaces as outlined in 5.3 on June 20 2014.

5.7 The redrawn winner’s name will be published on the ‘DR Strings Australia’ Facebook page and the Dominant Music Facebook Profile on the same day.

6. NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

6.2 Dominant Music & affiliates and associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3 Dominant Music& affiliates will not be liable for any misadventure, accident, injury, loss or claim that may occur:

a) during the draw;

b) whilst undertaking any activity in or connected with their entry into the draw

c) in the participation in any prize;

d) as a consequence of late, lost or misdirected mail;

e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

f) in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion;

g) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this promotion;

6.4 Dominant Music assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.5 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition
